JazzLinx Social Media Platform: Terms and Conditions

Welcome to JazzLinx, The first and only Jazz social media platform dedicated to jazz enthusiasts worldwide. Before you begin using our services, please carefully read and understand the following Terms and Conditions. By accessing or using JazzLinx, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you may not use our services.

1. Acceptance of Terms: By accessing or using JazzLinx, you agree to comply with and be bound by these Terms and Conditions. These Terms govern your use of JazzLinx and all services provided through JazzLinx.
2. Eligibility: You must be at least 13 years of age to use JazzLinx. By using JazzLinx, you affirm that you are at least 13 years old. If you are under 13 years old, you may not use JazzLinx. If you are between the ages of 13 and 18, you must have parental consent to use JazzLinx.
3. User Accounts: a. You may be required to create an account to access certain features of JazzLinx. When creating an account, you agree to provide accurate and complete information. b. 4. Content: a. You retain ownership of any content you post on JazzLinx, including text, photos, videos, and audio recordings. b. By posting content on JazzLinx, you grant JazzLinx a non-exclusive, royalty-free, worldwide, perpetual, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content. c. You agree not to post any content that is illegal, defamatory, infringing, obscene, or otherwise objectionable. d. JazzLinx reserves the right to remove any content that violates these Terms or is otherwise inappropriate.
5. Privacy: a. Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose your personal information. b. By using JazzLinx, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
6. Intellectual Property: a. JazzLinx and its content, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the property of JazzLinx or its licensors and are protected by copyright, trademark, and other intellectual property laws. b. You may not use JazzLinx’s intellectual property without the prior written consent of JazzLinx.
7. Prohibited Conduct: a. You agree not to engage in any conduct that violates these Terms or is harmful to other users of JazzLinx. b. Prohibited conduct includes, but is not limited to, spamming, harassing other users, impersonating another person, and engaging in illegal activities.
8. Termination: JazzLinx reserves the right to terminate or suspend your access to JazzLinx at any time and for any reason without prior notice.
9. Changes to Terms: JazzLinx reserves the right to modify or update these Terms and Conditions at any time. Changes will be effective immediately upon posting to JazzLinx. Your continued use of JazzLinx after any such changes constitutes acceptance of the modified Terms.

12. Prohibited Content:
    a. You agree not to post any content that includes explicit sexual images, promotes or glorifies bullying, encourages aggressive behaviour, or expresses racism in any form.
    b. JazzLinx has a zero-tolerance policy towards such content. Any user found posting such content will have their account immediately terminated without prior notice.

Terms and Conditions for Jazz Calendar on JazzLinx

1. Acceptance of Terms By accessing and using the Jazz Calendar (“Service”) provided by JazzLinx, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not subscribe to or use the Service.

2. Service Description JazzLinx provides a jazz event calendar service that aggregates performance schedules from over 10 jazz clubs worldwide. Users receive a 7-day trial period beginning on the date of registration. After the trial period, continued access to the Service requires a subscription at a cost of $4 per month, charged automatically via Stripe payment gateway.

3. Subscription Terms Your subscription begins immediately after the trial period ends, provided payment is successfully processed. The subscription fee is non-refundable and will be automatically renewed each month unless cancelled by you. Subscriptions can be managed and cancelled by accessing your user profile on the JazzLinx website.

4. Accuracy of Information JazzLinx takes care to ensure the accuracy of the information provided in the Service. However, the information is largely supplied by third-party jazz clubs and is subject to change. JazzLinx is not responsible for inaccuracies, errors, or omissions in the information provided, nor for any failure to update information. We do not guarantee the accuracy, completeness, or timeliness of the information displayed and will not be liable for any reliance you place on such information.

5. Third-party Services JazzLinx does not sell tickets nor is directly affiliated with any of the jazz clubs listed. Any ticket purchases are transactions made directly with the respective jazz clubs or through their designated ticketing agents. JazzLinx may display ticket prices, but these are subject to change and are controlled by the respective club or event organizer.

6. Limitation of Liability JazzLinx shall not be liable for any damages, direct or indirect, resulting from the use of the Service or from any information, content, materials included on or otherwise made available to you through the Service. Your use of the Service is at your sole risk.

7. Indemnification You agree to indemnify, defend, and hold harmless JazzLinx and its directors, officers, employees, contractors, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Service using your Internet account.

8. Modifications to Terms JazzLinx reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms at any time. It is your responsibility to check these Terms periodically for changes. Your continued use of the Service following the posting of changes will mean that you accept and agree to the changes.

Terms and Conditions for JazzLinx Jazz Courses

1. Introduction
Welcome to JazzLinx Jazz Courses! These Terms and Conditions govern your participation as a course creator on the JazzLinx platform, which is managed and operated by JazzLinx (“we”, “us”, “our”). By creating, submitting, and monetizing courses on JazzLinx, you agree to comply with these Terms and Conditions.

2. Course Creation and Submission
As a course creator, you are invited to propose jazz-related educational content via our platform. Once you submit a proposal and it is approved by our administrative team, you will gain access to our dashboard to develop your course. Each course must meet our quality and content standards before it can be published. Submission of a course does not guarantee publication, and all courses are subject to approval by our team.

3. Revenue Sharing and Payments
For each course sold, course creators will receive seventy-five percent (75%) of the net revenue, and JazzLinx will retain twenty-five percent (25%). Payments to course creators are processed through the platform, and funds become available for withdrawal once they exceed $300 USD in accumulated earnings.

4. Withdrawal Policy
Course creators may request a withdrawal once their available balance meets or exceeds the $300 threshold. All funds must remain in your JazzLinx account for a minimum of seven (7) days before they are eligible for withdrawal. Withdrawal requests are subject to processing times, which may vary.

5. Technical Issues and Support
While JazzLinx strives to maintain a high level of service, occasional technical issues may occur. JazzLinx is not liable for interruptions to service but will endeavor to provide timely assistance. Please contact our support team for help with any technical issues related to course creation, submission, or monetization.

6. Intellectual Property Rights
By submitting content to JazzLinx, you affirm that you are the owner of or have the necessary licenses, rights, consents, and permissions to use and to authorize JazzLinx to use all intellectual property rights in and to any and all of your submitted content. You grant JazzLinx a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the JazzLinx platform and JazzLinx’s (and its successors’ and affiliates’) business.

7. Account Termination and Suspension
JazzLinx reserves the right to suspend or terminate your account if you are found to have breached any of the terms outlined here, including but not limited to infringing on intellectual property, misusing the platform, or engaging in fraudulent activities.

8. Amendments
These terms may be amended from time to time at our discretion. Your continued use of the platform after any such amendments signifies your acceptance of the changes.

9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which JazzLinx operates. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
